Rental costs are costs paid in advance by the property owner, which they have the right to have reimbursed by the tenant.  

What are rental costs?   

Rental costs are also called “service charges”. They have been paid in advance by the property owner and they can request the tenant to pay them back. The property owner subsequently passes on certain costs to the tenant.  

What are the costs in question?   

Rental costs are costs relating to several things.   

Elevators and lifts 

  •  electricity,
  • operation (periodic visit to check them, cleaning, half-yearly examination of cables, upkeep of a file by the maintenance company, outlining technical visits, incidents), 
  • supplying products or small maintenance equipment (cloths, necessary grease and oil, lighting for inside the lift), 
  • minor repairs inside the lift (changing lift buttons, door hinges), bearings (mechanical, electrical or pneumatic door shutters), and fuses.

 Cold water, hot water and collective heating  

  • cold and hot water for all occupants, 
  • water needed for routine maintenance of shared areas, including the water treatment plant, 
  • water needed for routine maintenance of outside spaces, 
  • products needed to operate, maintain and treat the water, 
  • energy supply, whatever its type, 
  • operation of general and individual meters and maintaining smoke purifiers, 
  • repairing leaks on joints.

 Individual facilities 

  •  heating and producing hot water, 
  • as well as distributing water into private areas (testing connections, adjusting flow and temperatures, troubleshooting, replacing flush joint bells).  

Indoor shared areas 

  • electricity, 
  • supplying maintenance products (brooms and bags needed to get rid of waste) and products to get rid of insects and disinfection products, 
  • maintaining the time switch, mats, rubbish chutes, 
  • repairing and maintaining cleaning equipment, such as the vacuum cleaner, 
  • maintenance staff costs.

Outside spaces  

  • traffic lanes, 
  • parking areas, 
  • grass and shrubbery area borders, 
  • and games equipment for children.

Taxes and fees  

Certain taxes are also the tenant’s responsibility:   

  • tax or fees for removing household waste, 
  • road sweeping tax, 
  • sanitation fees.

 Who pays rental costs?  

 It is subsequently down to the tenant to pay these costs, if the property owner so requests it. If the tenant has difficulties paying the costs, they can request the property owners gives them payment deadlines.   

When are rental costs paid?  

Paying rental costs can be done in 2 ways:   

  • by paying for “provisions for costs”, every month or every quarter 
  • by a one-off reimbursement of the costs paid by the property owner 

How are the costs justified?   

The landlord/landlady must make supporting documents for the costs available to the tenant, for 6 months after sending the payment request.   

How is the payment made?   

Once a year, if the tenant pays “provisions for costs” every month or every quarter, one payment must be made. Then, the total regular payments from the tenant are compared with the actual costs paid by the property owner.  
If the provisions paid by the tenant are more than the property owner’s costs, the property owner must refund the overpayment to the tenant. If the opposite is the case, they can request an additional payment.   

Please note: in a co-rental or a furnished rental, for which the lease agreement has been signed since 27th March 2014, rental costs do not have to be paid if they appear in the form of a fixed price in the lease agreement.
